1. The Operator's role

Sole Proprietor Kostin Gleb Yurievich (INN 784001826750, OGRNIP 318784700122070; the "Operator") acts as an information intermediary within the meaning of art. 1253.1 of the Civil Code of the Russian Federation (the "GK RF") for content uploaded by users of the .solutions ID service (the "Service").

The Operator does not moderate user content in real time and does not initiate its transmission. Under clause 3 of art. 1253.1 GK RF, the Operator is exempt from liability where (a) the Operator did not know and should not have known about the unlawfulness of the use of the relevant object and (b) the Operator took the necessary and sufficient measures to stop the infringement upon receipt of a properly formed written notice from the rights-holder.

2. Primary procedure: notice under art. 15.7 of Federal Law 149-FZ

Russian rights-holders or other persons who believe that content infringing their exclusive rights has been posted on the Service send a written notice to the Operator at legal@solu.id. The notice must comply with art. 15.7 of Federal Law of 27.07.2006 № 149-FZ "On Information, Information Technologies and the Protection of Information" (the "149-FZ") and contain:

1. the rights-holder's details (for a natural person — full name, passport data, contact information; for a legal entity — name, INN/OGRN, registered address, contact person, contact information);

2. identification of the protected object — a specific work, sound recording, image, distinctive sign, etc., with a reference to the source confirming the rights-holder's title;

3. the domain name and/or URL of the Service page where the disputed object is published (e.g. https://solu.id/{identifier}/...);

4. confirmation that the rights-holder has not authorised the use of the object;

5. consent to the processing of the rights-holder's personal data to the extent necessary for the review of the notice and the action.

If the notice is sent by an authorised representative, a copy of the authorisation must also be attached.

3. Reaction time and procedure

Pursuant to part 5 of art. 15.7 of 149-FZ, within twenty-four (24) hours of receiving a properly formed notice the Operator:

  • removes the indicated content or restricts access to it pending resolution of the dispute;
  • notifies the user who posted the content and informs them of the right to submit a counter-notice.

If the notice does not meet the requirements of art. 15.7, the Operator notifies the sender within twenty-four (24) hours and grants seven (7) days to cure the deficiencies.

4. Counter-notice

A user whose content has been restricted or removed may submit a counter-notice to legal@solu.id justifying the lawfulness of the publication (licence, public domain, fair quoting, any other lawful basis) with supporting documents.

On receipt of a properly formed counter-notice, the Operator forwards it to the rights-holder and decides whether to restore access or to maintain the restriction taking into account the parties' arguments.

5. Additional procedure for foreign rights-holders (DMCA Takedown)

For the convenience of foreign rights-holders acting under U.S. law, a DMCA Takedown procedure is also available under 17 U.S.C. § 512.

DMCA notices are sent to legal@solu.id and must contain:

1. the signature (physical or electronic) of a person authorised by the rights-holder; 2. identification of the protected work; 3. identification of the material to be removed; 4. the sender's contact details; 5. a good-faith statement; 6. a statement of accuracy and authorisation.

The DMCA procedure does not replace art. 15.7 of 149-FZ and runs in parallel.

6. Repeat-infringer policy

If a User repeatedly (more than two confirmed cases within six months) posts infringing content, the Operator may restrict or terminate access to the Account under section 13 of the Terms of Service.

7. False notices

The sender bears liability under arts. 306, 1253 GK RF and arts. 128.1, 159 of the Criminal Code of the Russian Federation (where the elements of the offence are present) for the wilful submission of knowingly false notices that lead to the removal of lawfully posted content.
